This Privacy Policy describes policies and procedures on the collection, use and disclosure of your information when using Pulse Evangelism website or services.

Pulse Evangelism is committed to protecting the privacy and security of your personal information. The information you share with Pulse allows us to provide you with the best experience with our services. Pulse protects the personal information we collect and ensures your personal information is handled properly worldwide. Please read below to learn how we collect, use, and disclose personal information.

This Privacy Policy applies to Pulse and covers our processing activities as a data controller. By using the services of Pulse, you agree to the collection and use of information in accordance with this Privacy Policy.

The websites and services of Pulse affiliates are governed by separate terms of use and privacy policies. Pulse’s Site (including mobile) are owned and operated by Pulse Outreach, with its principal place of business at 600 S. 9th Street, Minneapolis, MN 55404.

Definitions

For the purposes of this Privacy Policy: Account means a unique account created to access our Service or parts of our Service.

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

1. Types of Data Collected Information Collected by Our Site.

To make our Site more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type Internet service Provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Site, track users’ movements around the Site, gather demographic information about our user base as a whole, and better tailor our Site to users’ needs. For example, some of the information may be collected so that when you visit the Site, it will recognize you, and the information could then be used to serve advertisements and other information appropriate to your interests. Except as noted in this Privacy Policy, we do not link this automatically-collected data to Personal Data.

Cookies. We also use cookies and URL information to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a web site. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. Persistent Cookies can be removed by following Internet browser help file directions.

Personal Information. We collect your phone number to begin a conversation regarding our Services. It is option to provide your name and email, which will be used for conversation purposes. Analytics. We currently use an analytics service to track visitor interaction with the Site. This service collects information anonymously and reports website trends without identifying individual visitors. Analytics uses its own cookies to track visitor interactions. The purpose of the analytics service is to allow Pulse to view a variety of reports about how visitors interact with their website, using the information to improve our website and how people find it.

Information Collected from Other Sources. We may obtain information about you from other sources, such as public databases, joint marketing partners, and other third parties. Examples of the information we may receive from other sources include social media profile information, marketing leads and search results and links, and paid listings (such as sponsored links).

2. Data Usage

General Use. We use your Personal Data in the following ways: (1) to identify you as a user in our system; (2) to improve our Site and the quality of experience when you interact with our Site; (3) to send you e-mail notifications; (4) to respond to your inquiries; and (5) to send you promotional emails related to Pulse Outreach. Creation of Anonymous Data. We may create anonymous data records from Personal Data by excluding information (such as your name) that make the data personally unidentifiable. We use this anonymous Data to analyze request and usage patterns so that we may enhance the content of our Site and improve Site navigation. Pulse reserves the right to use anonymous Data for any purpose and disclose anonymous Data to third parties in its sole discretion.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Disclosure of Your Personal Data

We disclose your Personal Data as described below and as described elsewhere in this Privacy Policy.

Third-Party Service Providers. We may share your Personal Data with third party service providers: to provide you with access to the Site and to respond to your requests; to conduct quality assurance testing; to provide technical support; and/or to provide other services to Pulse. Affiliates. We may share some or all of your Personal Data with our joint ventures or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy.

Corporate Restructuring. We may share some or all your Personal Data in connection with or during negotiation of any merger, financing, acquisition or dissolution, transaction or proceeding involving sale, transfer, divestiture, or disclosure of all a portion of our organization or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Data may also be transferred as an asset. If another organization acquires Pulse, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy.

Other Disclosures. Regardless of any choices you make regarding your Personal Data (as described below), Pulse may disclose the data if it believes in good faith that such disclosure is necessary (1) in connection with any legal investigation; (2) to comply with relevant laws or to respond to subpoenas or warrants; (3) to protect or defend the rights or property of Pulse or users of the site; and/or (4) to investigate or assist in preventing any violation of the law or this Privacy Policy.

Third Party Websites. When you click on a link to any other website or location, you will leave our Site and go to another site and another entity may collect Personal Data or anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites. We encourage you to read the privacy policies of every website you visit. The links to third party websites or locations are for your convenience and do not signify our endorsement of such third parties or their products, content or websites.

Choices Regarding Your Personal Data

Choices. We may periodically send you promotional emails related to Pulse. When you receive such promotional emails from us, you may indicate a preference to stop receiving further promotional emails from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly. Despite your indicated e-mail preferences, we may send you service related communication, including notices of any updates to our Site terms and conditions or this Privacy Policy.

Cookies. If you decide at any time that you no longer wish to accept Cookies from our Site for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser’s technical information. If you do not accept Cookies, however, you may not be able to use all portions of the Site or all functionality of the Site.

Deleting Your Personal Data. You may request Pulse to delete your Personal Data, but in some cases Pulse may be required to keep this information and not delete it; or to keep this information for a certain time period, in which case Pulse will comply with your deletion request only after Pulse has fulfilled such requirements). When Pulse deletes any Personal Data, it is deleted from the active database, but may remain in our archives. Email team@pulse.org to request your personal information be deleted or to request a copy of the data or conversations Pulse has retained.

Retention of Personal Data

Length of Retention. Pulse will retain Your Personal Data provided through user-initiated conversations indefinitely. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. Pulse will also retain usage Data for internal analysis purposes. Usage Data is generally retained for a set period of time, except when this data is used to strengthen the security or to improve the functionality of our Site.

Transfer of Your Personal Data

Consent to Transfer. Your information, including Personal Data, is processed at Pulse’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your country or governmental jurisdiction where the data protection laws may differ. Your consent to this Privacy Policy followed by submission of Personal Data represents your agreement to a transfer. Pulse will take all steps reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this Privacy Policy. No transfer of Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Personal Data.

Other Provisions

Security of Your Personal Data. Although we use a variety of industry-standard security technologies and procedures to help protect your Personal Data from unauthorized access, use, or disclosure, no method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, Pulse cannot guarantee its absolute security.

Do Not Track. Do Not Track is a privacy preference that can be configured in certain web browsers (the “DNT Feature”). The DNT Feature, when enabled on a web browser, signals the websites you visit that you do not want certain information about your visit collected. The Internet industry is in the process of defining how to interpret signals sent by the DNT Feature, and Pulse does not currently respond to, or recognize, DNT Feature signals.

Children’s Privacy. Pulse does not address anyone under the age of 13 without parental supervision. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and become aware your child has provided Pulse with Personal Data, please contact us. If Pulse becomes aware of collected Personal Data from individuals under the age of 13 without verification of parental consent, we will take steps to remove that information.

Disclaimers and Limitation of Liability.

Access to Pulse’s Site is provided on a “as is” and “as available” basis, “with all faults” and without warranty of any kind. Pulse, its licensors, and its affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to the Site and any offered services, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Pulse knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Pulse, its licensors, and its affiliates make no warranty that (1) the Services will operate properly, (2) that the Services will meet your requirements, (3) that the operation of the Services will be uninterrupted, bug free, or error free in any or all circumstances, or (4) that any defects in the Services can or will be corrected. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed. Pulse and its affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Services. This paragraph will apply to the maximum extent permitted by applicable law.

Further, to the maximum extent permitted by applicable law, neither Pulse nor its affiliates, nor any of Pulse’s service providers (collectively, the “Pulse Parties”), shall be liable in any way for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, arising out of or in connection with this Agreement or the Services, or the delay or inability to use or lack of functionality of the Services, even in the event of a Pulse Party’s fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if a Pulse Party has been advised of the possibility of such damages.

Indemnity. You agree to indemnify, pay the defense costs of, and hold Pulse and its affiliates, employees, officers, directors, agents, contractors, and other representatives harmless from all claims, demands, actions, losses, liabilities, and expenses (including attorneys’ fees, costs, and expert witnesses’ fees) that arise from or in connection with (a) any claim that, if true, would constitute a breach by you of this Agreement or negligence by you, or (b) any act or omission by you in using the Services. You agree to reimburse Pulse on demand for any defense costs incurred by Pulse and any payments made or loss suffered by Pulse, whether in a court judgment or settlement, based on any matter covered by this provision. If you are prohibited by law from entering into the indemnification obligation above, then you assume, to the extent permitted by law, all liability for all claims, demands, actions, losses, liabilities, and expenses (including attorneys’ fees, costs and expert witnesses’ fees) that are the stated subject matter of the indemnification obligation above.

Governing Law and Jurisdiction.

You agree that this Agreement will be deemed to have been made and executed in the State of Minnesota, U.S.A., and any dispute will be resolved in accordance with the laws of Minnesota, excluding that body of law related to choice of laws, and of the United States of America. Any action or proceeding brought to enforce the terms of this Agreement or to adjudicate any dispute must be brought in the state or federal courts encompassing Hennepin County, Minnesota. You agree to the exclusive jurisdiction and venue of these courts. You waive any claim of inconvenient forum and any right to a jury trial. Any law or regulation which provides that the language of a contract shall be construed against the drafter will not apply to this Agreement.

Class Action Waiver.

You agree not to bring or participate in a class or representative action, private attorney general action, or collective arbitration related to the Services or this Agreement. You also agree not to seek to combine any action or arbitration related to the Services or this Agreement with any other action or arbitration without the consent of all parties to this Agreement and all other actions or arbitrations. Termination. This Agreement will terminate automatically without notice if you fail to comply with any of the conditions herein or with Pulse’s Terms of Use. You may also terminate this Agreement by deleting your account with Pulse. Upon termination, you will lose all rights to access or use the Site and Services. Contact Information.
